In-depth Understanding

Family Mediation Services

In family law mediation, you and your partner discuss settlement options face to face with the assistance of an independent mediator who will assist you to identify the issues and help you reach your own solution. The mediator is not there to give legal advice to either party but will instead facilitate discussions on a neutral basis between you both.

Our family law mediation services include supporting and advising you whilst you attend mediation, formalising agreements reached during the course of family mediation or our in-house mediator, Sam Haslam, can also conduct mediations for both parties to attend.

Collaborative Law Solicitors

Collaborative Law is a process whereby discussions take place in a series of meetings at which you and your former partner and your respective lawyers are all present. The approach in collaborative family law is a holistic one where the parties, not the lawyers, drive the issues for discussion. What is unique about Collaborative Law is that if the process breaks down, new solicitors have to be appointed which provides both parties with an incentive to commit to resolving matters without involving the Court.

Lyn Ayrton is a qualified Collaborative Law solicitor.

Private Financial Dispute Resolution (pFDR)

The Financial Dispute Resolution hearing (FDR) is a key stage of the financial proceedings held within the court process where a judge provides his or her opinion of the likely outcome if the case proceeds to a full hearing. The intention is that the parties then try and negotiate an agreement having heard that indication. However, given the pressures on the courts, judges have limited time to devote to each individual case. The Private Financial Dispute Resolution mirrors the stage but differs from the court process as the parties specifically appoint the ‘judge’ who will make that case their absolute priority and will have had plenty of time to read into and thoroughly understand all the issues. Because the parties appoint the Private Financial Dispute Resolution judge, the hearing can be scheduled to take place at a time and location convenient for them.

Lyn Ayrton sits as a pFDR Judge.

Family Law Arbitration

Family Law Arbitration is a key form of alternative dispute resolution (ADR) Like a Judge in court, an Arbitrator will make a binding decision at the end of the family arbitration hearing. Unlike court, you have control over the choice of the Arbitrator and can adopt a bespoke structure and timetable to suit your case. Our experienced family law specialists can represent you within the Family Law Arbitration process, providing pragmatic and concise advice on the likely outcome and thereby managing your legal costs.

Frequently Asked Questions

Below you will find a list of the commonly asked questions that our Non Court Dispute Resolution lawyers face. If you have any other NCDR question, please reach out to our solicitors for further advice.

NCDR can often be quicker, less expensive, and less stressful than court proceedings. It also offers more flexibility and can help preserve relationships between the parties.

Not all cases are appropriate for NCDR, but it can be highly effective in family matters, commercial disputes, employment issues, and neighbour disagreements. Complex cases or those involving urgent legal action may still require court involvement.

The length of the process depends on the complexity of the issue and the willingness of both parties to reach an agreement. Mediation sessions, for example, can often be arranged and completed within a matter of weeks.

If NCDR does not lead to a resolution, parties still have the option of pursuing the matter through the courts. In many cases, attempting NCDR is a necessary step before litigation.

Yes. Most forms of NCDR, including mediation, are confidential. This means that discussions held during the process cannot usually be used as evidence in court if the matter proceeds.
